[雇主担保签证] 高人请进:856雇主担保签是否可以豁免2年的澳洲工作经历 [复制链接]

我是拿457登陆的,有人跟我讲可以不用在澳洲工作2年,直接申请856,只要我能通过职业评估,不知道这种说法是不是真的?

没有说通过职业评估就可以免, 但是如果能证明是符合Exceptional circumstances的可以豁免. 另外856的是3年工作经验的.


Detailed guidelines on when you need to have your visa
application considered under ‘exceptional circumstances’ and
what additional information the department requires to process
your visa application in these circumstances can be found in
booklet 5, Employer Sponsored Migration.
Exceptional circumstances on the basis of experience might be
considered for the ENS if the position is so unusual or highly
specialised that it is not possible to find a suitable person who
has 3 years post-qualification work experience.
Exceptional circumstances on the basis of qualifications might
be considered for the RSMS if the duties for the position require
less than a diploma, and you have been working in the position
on an appropriate temporary residence visa for at least 2 years
immediately prior to lodging the visa application.
Other considerations for both the ENS and the RSMS are
whether the position is critical to the operation of your
employer’s business and whether the occupation is on the
Migration Occupations in Demand List (MODL).
Exceptional circumstances on the basis of age might be
considered where:
• it is not possible to find a suitably qualified person younger
than you; and
• the position is so specialised or unique that few, if any,
persons under 45 would have sufficient expertise to fill it; or
• the position would normally require a person with skills and
experience acquired over many years (eg. senior academics
or scientists).
Exceptional circumstances on the basis of English language
ability might be considered where the nature of the work to be
performed and whether English is essential to perform the full
range of required duties.
In addition, if you do not have functional English, you and/or
your nominating employer will need to demonstrate that:
• a suitably qualified person who does have functional English
is not available; and
• a person without functional English is able to perform all
duties and comply with all Occupational Health and Safety
(OH&S) requirements.

Where a nominee has qualifications that have been assessed as
equivalent to the Australian standard by the appropriate
assessing body in Australia, but does not have 3 years
post-qualification work experience, exceptional circumstances
may be considered. To assist in this consideration you may
provide details at Question 21 on this form, of why the position
is so unusual or highly specialised that a suitable employee with
3 years post-qualification work experience cannot be found.
Other considerations are whether the position is critical to the
operation of the business and whether the occupation is on the
Migration Occupations in Demand List (MODL)

移民局的网站上不是说在澳洲工作满2年,其中最近一年必须在提出担保的雇主那里工作么

你看的是RSMS吧, 那是边远地区的857

不过哪个都好, 都没有说明通过职业评估就可以豁免的.

856签证申请确实只要通过技术评估再加上3年的相关工作经验就可以申请。当然3年工作经验在特殊情况下可以豁免
